 TPS first and H4 later

I and my spouse are in transition to H1/H4 status. My new employer has not send the documents to the USCIS yet but will be doing so in a month or so. As I am going to be H1, I am not applying to TPS while my spouse who will be H4 (after applying) wants to apply for TPS. Let's say if my spouse apply for TPS in a week. Will there be a problem when my new employer apply for H4 on her behalf? I would appreciate your suggestion and advise in this context. Thank you.
